With everything going on in the world, naturally, there would be a lot going on in an emerging industry like vaping. The B.C Provincial Government is going to be introducing their own Province-wide regulations (Called B.C’s E-Substances Regulation or for short E.S.R). We’re going to cover what the E.S.R will look like as well as some of the previous vape regulations leading up to what its become today.
The E.S.R will change internal regulations Vape Companies will need to adhere too but also laws that will affect the everyday vaper. We’ll go over what those laws look like and what to expect in the upcoming months.
From The Inception Until The First Regulations
Since vape products hit the shelves in Canada there’s been two big rounds of changes to mostly the labeling of Vape Juices. Initially, the industry sprouted so fast it was hard for lawmakers to make sensible laws without first understanding what they were dealing with.
C.C.C.R, 2001
The first set of laws to affect the Canadian Vape Industry was The Consumer Chemicals and Containers Regulations, 2001 (CCCR 2001) which took effect in May of 2018. These laws weren’t designed specifically for vape products but were rather a generic regulation on all consumer chemicals that posed any sort of health risk. This was then used as a band-aid for some of the frustrations faced by consumers over the outlandish packaging that was created in the rapidly developing industry.
The CCCR 2001 introduced the mandatory infamous Skull & Crossbones (Poison Symbol) on all of the eJuices we still see.
What The Industry Looks Like Now..
V.P.L.P.R
The Vaping Products Labeling and Packaging Regulations (Or simply VPLPR) were enacted on April 1st 2020. This is the first time regulations were created specifically for the Canadian Vape Industry. The VPLPR is a federal law which means it affects all of Canada.
Once again, these laws were mostly targeted at the labeling / Bottling of eJuice opposed to any hardware. Some of the new eJuice Bottling requirements were:
- Typography (Minimum Size and Specific Fonts)
- Black Type on White Backgrounds
- Warning Messages
- Where the eJuice was Manufactured
- Child Proof Containers
- How to Open & Close Child Proof Containers
- Batch ID’s
- Mandatory Nicotine Strength
- And a few other smaller details..

E-Substance Regulations (E.S.R)
The E-Substance Regulations (British Columbia Only) is a new province-wide regulation set to be enacted on September 15th 2020. This is going to be the first time and regulations have affected the hardware of vape devices.
These are by far the most aggressive laws put into place. Instead of working with what the industry has become and monitoring / regulating it, this will be the first time that lawmakers have started to remove abilities and creative control industry leaders have.
The New Laws..
Here’s the difference you, the consumer, will see in the coming month:
- No flavour (except tobacco) will be sold in all age establishments (i.e gas stations, convenience stores).
- Plain Packaging for Vape Juices / Pods / Disposables.
- No Nicotine Strength over 20MG (Salt or Free-Base).
- Volumetric Restriction. No bottles containing over 30 mL of eJuice will be sold.
- No Tanks that holds or can hold more than 2 mL.
